By purchasing or renting any Kirlian photography device (“Device”), you agree to this Waiver & Release (“Agreement”).
1. Assumption of Risk
You acknowledge the Device uses high-voltage electricity and involves risks including electrical shock, injury, property damage, or death. You voluntarily assume all such risks, whether known or unknown.
2. Disclaimer of Warranties
The Device is provided “as-is.” Images SI Inc. disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.
3. Limitation of Liability
To the fullest extent permitted by New York law, Images SI Inc. and its officers, employees, and affiliates are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from the purchase, use, misuse, or failure of the Device.
4. Indemnification
You agree to indemnify and hold harmless Images SI Inc. and its representatives against all claims, damages, costs, and attorney’s fees resulting from your use or misuse of the Device or your violation of this Agreement.
5. Safety Obligations
You agree to follow all safety instructions, including:
- Use proper voltage and a dry workspace; wear rubber-soled shoes.
- Do not use if you have a pacemaker, are pregnant, or are otherwise medically at risk.
- Wear UV-protective eyewear; limit skin exposure to one (1) minute per day.
- Do not operate more than 30 seconds continuously; allow one minute of cooling between uses.
- Ensure adequate ventilation (ozone exposure); keep away from sensitive electronics.
- Disconnect power before handling; never leave the Device unattended while plugged in.
- Device is for adults (18+) with adequate training only.
6. Certification
By signing, you certify you are at least 18 years old, understand the risks, and release Images SI Inc. from liability for any injuries or damages arising from use of the Device.
7. Governing Law & Venue
This Agreement is governed by the laws of the State of New York. Exclusive venue lies in the state or federal courts located in New York County, New York.
8. Severability
If any provision is found unenforceable, the remaining provisions remain valid and enforceable to the fullest extent permitted by law.
